Current service. These Terms govern the current public musen consumer service: free personal Live Radio for registered users through the musen applications for iPhone and Android. Planned, dormant and research capabilities are not made available merely because they are described elsewhere.

1. Who operates musen and how these Terms apply

These Terms are a contract between you and Fabio Senna, an individual carrying on business under the trading name musen, at 483 Green Lanes, N13 4BS, United Kingdom. In these Terms, "Operator", "we", "us" and "our" mean that individual. "musen" is the name of the Service and is not a separate legal entity.

When the contract begins. These Terms apply when they are presented to you and you affirmatively accept them through the acceptance control provided during account registration, sign in or another authenticated entry point. We record the accepted version and acceptance time. If you do not agree, do not use the Service.

Document hierarchy. For the current consumer service, these Terms govern the contract. The Privacy Policy explains how personal data is processed. The Community and Broadcasting Guidelines govern applicable conduct and User Supplied Materials. Feature specific terms govern a future feature only when they are presented for that feature and accepted where required. Applicable law always prevails.

Informational materials, including the FAQ, User Guide, Manifesto, Community Constitution, research papers, architecture documents and Project Checkmate materials, do not create contractual promises unless these Terms or a separate binding agreement expressly say otherwise.

2. Eligibility and accounts

You must be at least 13 years old to use the current Service. If you are under the age of legal majority where you live, you may use the Service only where applicable law permits and with parent or legal guardian involvement where required. Higher minimum ages or additional safeguards may apply in some countries or to future higher risk features.

You may not use the Service where doing so would violate applicable sanctions, export controls or other law.

Account requirement. The current public listening experience requires an account. You must provide information that is reasonably accurate and keep control of the authentication method shown in the app. Supported authentication methods may change and are those presented in the current app.

You must take reasonable steps to protect your credentials and tell us promptly if you suspect unauthorised access. You are responsible for activity you authorised or caused. You are not responsible merely because activity occurred through your account, including where it resulted from circumstances outside your reasonable control. We may take reasonable steps to secure or suspend a compromised account.

3. The Service available now

The current public Service is free personal Live Radio for registered users through the musen applications for iPhone and Android. An internet connection is required.

The current Service allows you to listen to a personal radio and configure aspects of that radio, including Requests and settings made available in the app. The website may provide marketing, support, legal, account or informational surfaces, but a generally available web listening player is not part of the current public Service.

The current public Service does not include:

• paid subscriptions, paid plans, credits or in app purchases
• public creator tools or public music uploads
• user operated public broadcasting
• public Segment creation, replay or sharing
• a separate public AI DJ mode
• a generally available web player

Dormant code, technical documentation, product plans, research papers or references to future features do not make those features available and do not create a commitment to release them.

4. Requests, personalisation and automated systems

Requests. A "Request" is text, recorded speech or a picture that you choose to submit so that musen can interpret your listening intent. A Request is a preference signal, not a command or guarantee. The resulting radio may respond gradually, may not include a requested artist, track, topic or mood, and may refuse or limit Requests for legal, safety, rights, technical or policy reasons.

Where supported, a voice Request may be transcribed or interpreted and a picture Request may be analysed into a description or other signal used to shape the radio. These inputs are not transformed into new songs.

Personalisation. The Service uses automated selection and scheduling and may adapt based on Requests, settings, listening activity and other permitted signals described in the Privacy Policy. Personalisation is intended for entertainment. It does not determine your legal rights, access to essential services, credit, employment, health care or similar matters.

Requests and other inputs may be classified, limited or refused where reasonably necessary to protect people, rights, the Service or applicable legal and platform requirements.

5. Live Radio and the AI Host

Live Radio. Live Radio is musen's current personal listening service. It assembles and streams a continuing radio programme for your account using existing music recordings made available under the applicable rights basis, musen jingles and, if you enable it, synthetic AI Host speech. The current Service does not generate new songs.

The Service uses automated selection and scheduling within rules, rights decisions and editorial standards set or approved by the Operator. Nothing in these Terms determines whether the Operator has a particular legal status such as broadcaster, publisher, editor, hosting provider or intermediary. Any legal characterisation depends on the relevant facts and applicable law.

AI Host. The AI Host is optional synthetic speech presented as part of the radio programme. It may introduce music or provide short entertainment or informational talk moments. It is not a general purpose chatbot, an adviser, an emergency service, a community authority or an official source. It may be enabled, disabled or configured through controls made available in the app.

AI Host speech may be inaccurate, incomplete, repetitive or unsuitable for a particular purpose. Do not rely on it for medical, legal, financial, safety critical or other professional decisions. Where applicable law requires disclosure of synthetic or AI generated speech, musen will provide the required disclosure through the Service or another appropriate means.

6. Music, rights and permitted listening

Content source does not determine permission. Music and other material may be used only where the Operator has, or reasonably relies on, a rights basis covering the relevant hosting, processing, communication, performance, distribution or other use. A permission for one service, territory, audience or use does not automatically permit another.

Catalogue content may be supplied under direct licences, collective arrangements, platform agreements, creator permissions or other lawful rights bases. Nothing in these Terms expands or overrides the rights granted by a rights holder.

Your listening licence. Subject to these Terms, the Operator grants you a limited, personal, revocable, nonexclusive and nontransferable right to use the current Service and listen to its streams for your private, noncommercial use. This does not grant any right to download, extract, record, rebroadcast, publicly perform, redistribute or commercially exploit the stream or any component, except where applicable law permits otherwise or a separate permission expressly allows it.

Analysis and model training. Permission to host, analyse, classify, recommend, sequence, stream or broadcast content does not include permission to train or fine tune a model on that content unless a separate written agreement expressly grants that permission for a stated purpose.

Availability. Music availability can change because rights, territories, catalogue participation, technical conditions or partner requirements change. A Request does not create a right to hear a particular recording, artist or catalogue item.

7. User Supplied Materials and conduct

The current Service may allow you to submit Requests, profile text, an avatar, station information, a station cover image and other personal configuration material. These are "User Supplied Materials". They are not public creator uploads merely because the Service can process or store them.

You keep whatever rights you lawfully hold in User Supplied Materials. You grant the Operator a limited, nonexclusive licence to host, reproduce, process, adapt for technical purposes and display those materials only to the extent reasonably necessary to provide, personalise, secure, support and moderate the Service, subject to the Privacy Policy and applicable law.

You must have the rights or authority needed to submit User Supplied Materials. You must not knowingly submit material that unlawfully infringes another person's rights, deceptively impersonates another person or organisation, contains illegal material, or is designed to exploit, attack or interfere with the Service.

The applicable parts of the Community and Broadcasting Guidelines form part of the conduct rules for User Supplied Materials and use of the Service. Where these Terms and those Guidelines conflict, these Terms control for the consumer contract, subject to applicable law.

8. Software, intellectual property and open interfaces

The Service includes software, interfaces, documentation, designs, marks, editorial systems, data structures and other material owned by or licensed to the Operator or other lawful rights holders. Except for rights expressly granted under these Terms or a separate licence, no rights are granted to you.

Some components, interfaces, documentation or experimental materials may be released under open source, source available, developer, research or other separate licences. The applicable separate licence governs those materials and prevails over inconsistent restrictions in these Terms for its subject matter.

Access to a public interface does not grant access to source code, model weights, private prompts, nonpublic APIs, scheduler internals, catalogue data, rights data, security systems, infrastructure, private accounting records or other nonpublic backend systems unless a separate licence expressly grants that access.

You must not bypass access controls, interfere with the Service, or use nonpublic interfaces without permission. Nothing in these Terms restricts a right that applicable law does not allow us to restrict, including any applicable nonwaivable rights relating to interoperability, security research or reverse engineering.

9. Future features and additional terms

We may introduce creator tools, Segments, uploads, public stations, broadcasting, social surfaces, developer access, research features, paid features or other capabilities in the future. Their appearance in plans, documentation or technical architecture is not a promise that they will be released.

Before you can use a future feature that involves uploads, public content, broadcasting, monetisation, creator rights, developer access or another materially different activity, we may require additional eligibility checks and additional terms or policies. Those terms must be made available before the relevant feature is used and will govern that feature.

No creator grants a music or content licence merely by accepting these consumer Terms. Any future upload or creator programme requires feature specific rights terms that identify the relevant permitted uses and economic conditions.

10. Privacy, device permissions and third party services

The Privacy Policy explains how personal data is processed. Accepting these Terms is not consent to optional data processing where separate consent or another legal basis is required.

Microphone, camera, photo library, notification, tracking or other device permissions are requested through the relevant device or app controls where needed. Granting a device permission does not create permission for unrelated processing.

The Service relies on third party services such as mobile operating systems, app stores, hosting, authentication, analytics, diagnostics, speech, language, search or infrastructure providers. Their own terms and privacy notices may apply to the services they provide directly to you. Their terms do not silently replace this consumer contract between you and the Operator.

Your installation and use of the iPhone or Android application may also be subject to the applicable store, device and operating system licence terms. Apple and Google are not parties to the musen Service contract merely because the app is distributed through their platforms.

11. Availability, changes and consumer conformity

Availability. We aim to provide the Service with reasonable care and skill, but uninterrupted or error free availability is not promised. Temporary interruptions may occur for maintenance, security, rights, infrastructure, capacity, technical failures or events outside our reasonable control.

Nothing in these Terms excludes your mandatory rights relating to the supply, conformity, security updates or remedies for a digital service.

Changes to the Service. We may change the Service to maintain security or conformity, comply with law or third party rights, respond to technical changes, prevent abuse, adapt to catalogue or rights conditions, or improve or adapt the Service. We will not charge you solely because of such a change.

If a change materially and negatively affects your access to or use of the Service, we will give clear advance notice on a durable medium where required and provide any right to terminate or other remedy required by applicable law. You may also end this contract at any time as described in Section 13.

12. Moderation, suspension, explanations and review

We may use automated signals and human review, where available and appropriate, to apply request restrictions, protect accounts, investigate abuse, handle rights concerns and enforce these Terms or the Community and Broadcasting Guidelines.

We may restrict content, a Request, a feature or an account where reasonably necessary because of a suspected breach, rights issue, security threat, safety concern, age or eligibility issue, legal obligation, platform requirement or material operational risk.

Where law requires an explanation for a material restriction, or where we otherwise provide one, we will aim to identify the principal reason and available review route. We may limit details where disclosure would create a safety or security risk, expose another person's protected information, compromise an investigation or conflict with law.

If a review mechanism is offered for a decision, you may use the stated process. The existence and scope of any review right depends on the feature, decision and applicable law. These Terms do not promise a review process that the Service has not implemented.

13. Ending the contract and account consequences

You may end this contract at any time by deleting your account through available account controls or by discontinuing use and requesting closure where appropriate. Ending the contract stops your right to use the Service.

We may suspend or end your access where reasonably necessary because of a material or repeated breach, fraud or abuse, serious security or safety risk, loss of eligibility, legal obligation, rights issue, platform requirement, or discontinuation of the Service. Where appropriate and legally required, we will provide notice and reasons before or after action depending on the urgency and circumstances.

Account deletion and contract termination do not necessarily mean that every record is removed instantly. Personal data deletion, anonymisation, backup expiry, lawful retention and third party authentication consequences are governed by the Privacy Policy and applicable law.

Provisions that by their nature need to continue after termination, including rights in the Service, restrictions on misuse, accrued rights and applicable dispute provisions, continue only to the extent necessary and lawful.

14. Responsibility, service limitations and liability

Automated selections and AI Host speech may contain errors or produce unexpected results. The Service is provided for entertainment and should not be treated as professional advice, an emergency service or a guaranteed source of factual information. These limitations do not remove any mandatory obligation that applies to the Service.

You are responsible for the User Supplied Materials and instructions you intentionally provide and for unlawful conduct you knowingly direct. The Operator remains responsible for the systems it designs and operates to the extent required by applicable law. Responsibility is not transferred to you merely because you initiated a Request.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, wilful misconduct, death or personal injury caused by negligence where applicable, or liability arising under mandatory consumer, data protection or other law.

To the extent permitted by law, neither party is responsible for losses that were not reasonably foreseeable when the contract was made. If you use the Service as a consumer for personal purposes, the Operator is not responsible for business losses that are unrelated to that consumer use. Any additional limitation depends on the mandatory law that applies to the Operator and to you.

15. Governing law and consumer rights

These Terms are governed by the laws of England and Wales, subject to the mandatory rules that apply to your contract. If you are a consumer, this choice does not deprive you of mandatory protections available under the law of the country where you habitually reside where applicable law provides those protections.

A consumer may bring proceedings in any court available under mandatory law. Before formal proceedings, either party may contact the other in good faith to try to resolve the issue, but this does not limit any right to seek a remedy or use a complaint mechanism provided by law.

Nothing in these Terms excludes or limits a right or remedy that applicable law does not allow the parties to exclude or limit.

16. Changes, notices and contact

Changes to these Terms. We may update these Terms for legal, security, operational or product reasons. We will explain material changes and give reasonable advance notice where required. If applicable law or the nature of a change requires fresh agreement, the change will not bind you until you accept it. Continued use may indicate acceptance only where that method is lawful and was clearly explained in the notice.

A new version will identify its effective date. Versions are archived so the Terms that applied at a particular time can be identified.

Notices and contact. General questions, complaints and legal notices relating to the current Service may be sent to info@musen.live. Security reports may be sent to admin@musen.live.

The canonical public version of these Terms is available at https://musen.live/terms. If a translated version differs from the English version, the legally controlling version is determined by applicable law and the publication notice for that translation.

Severability and no waiver. If a provision is invalid or unenforceable, it should be limited or severed only to the extent necessary, and the remaining provisions continue where legally possible. A delay in enforcing a right does not by itself waive that right.
